DECISION & ORDER ON MOTION

Motion by appellants, in effect, for leave to withdraw an appeal from a judgment of the District Court of Nassau County, First District, entered April 14, 2011, and for the release of funds on deposit.

Upon the papers filed in support of the motion and upon the stipulation of the parties, it is

ORDERED that the branch of the motion seeking, in effect, leave to withdraw the appeal is granted and the appeal is marked withdrawn; and it is further,

ORDERED that the branch of the motion seeking an order directing the release of funds on deposit is granted and the District Court of Nassau County, First District, is directed to release the funds on deposit in this matter to appellant Behrooz Benyamini, less any lawful fees.
