ORDER RE: NOTICE OF VOLUNTARY DISMISSAL


On July 3, 2003, the Court held a case management conference in the above-captioned matter. At the conference, the parties informed the Court that this case had settled and executed settlement papers in open court. On July 15, 2003, plaintiff filed a Notice of Voluntary Dismissal Pursuant to Rule 41(a)(1)(i). However, since defendants already filed a responsive pleading, the dismissal filed by plaintiff is insufficient under FRCP 41(a) to dismiss this case. Accordingly, the Court shall treat plaintiffs filing as a Request for Dismissal by plaintiff and hereby GRANTS her request. This entire action is dismissed with prejudice. The Clerk of Court shall close the file.

IT IS SO ORDERED.
