Hodas v. Hodas

Appellate Division of the Supreme Court of New York, Second Department
Oct 17, 1955
286 App. Div. 1027 (N.Y. App. Div. 1955)

Opinion

October 17, 1955.

In an action for separation, order granting respondent $50 a week temporary alimony and a $500 counsel fee modified by reducing temporary alimony to $30 a week. As so modified, order affirmed, without costs. Respondent offers no explanation of her joining in an income tax return which reported appellant's income far below that which she now swears he had. In view of the financial circumstances of the parties as disclosed by the papers herein, the award of $50 as temporary alimony was excessive. Wenzel, Acting P.J., MacCrate, Schmidt, Murphy and Ughetta, JJ., concur.
