ORDER

This case is calendared for trial at the Trial Session of the Court scheduled to commence on April 8, 2024, in New York, New York.

On March 7, 2024, Respondent filed with the Court a Motion for Continuance of Trial. Respondent informed that Court that Petitioner Katherine G. Miller has recently passed away, and they are awaiting documentation of passing for the purpose of informing the continued handling and disposition of this case on behalf of Petitioner Katherine G. Miller's estate. Respondent informed the Court that a trial would be premature and has requested this case be continued generally. Respondent also informed the Court that Petitioner Eric M. Hirsch does not object to the granting of this motion.

Upon due consideration, and for cause, it is

ORDERED that the caption of this case be amended to read: "Eric M. Hirsch & Katherine G. Miller, Deceased, Petitioners v. Commissioner of Internal Revenue, Respondent". It is further

ORDERED that Respondent's Motion for Continuance of Trial, filed with the Court on March 7, 2024, is granted and this case is stricken for trial from the New York, New York Trial Session of the Court scheduled to commence on April 8, 2024. It is further

ORDERED that this case is returned to the general docket for trial or other disposition.
