Himes v. Los Angeles County

Supreme Court of California
Jun 29, 1945
161 P.2d 10 (Cal. 1945)

Opinion

          Rehearing Granted July 26, 1945.

          In Bank.

Appeal from Superior Court, Los Angeles County; Alfred L. Bartlett, judge.

         Prior opinion, 152 P.2d 541.

Murphey & Davis, of Los Angeles, for appellant.

          J. H. O’Connor, Co. Counsel, and A. Curtis Smith, Deputy Co. Counsel, both of Los Angeles, and Clyde Woodworth, City Atty., of South Gate, for respondents.

          OPINION

          PER CURIAM.

This case presents for determination the same questions which were decided in S. Siwel Co. v. County of Los Angeles, Cal. Sup., 160 P.2d 789. It is conceded by counsel that the issues of fact and law in the two cases are identical, and that the Siwel decision will control the disposition of this appeal.

The judgment herein is reversed with directions to the trial court to overrule the general demurrer to appellant’s complaint and to proceed in accordance with the views stated in S. Siwel Co. v. County of Los Angeles, supra.

          TRAYNOR, Justice (dissenting).

I dissent for the reasons set forth in my dissenting opinion in S. Siwel & Co. v. County of Los Angeles, Cal.Sup., 160 P.2d 789.
