ORDER

This matter is before the Court on plaintiff's request for an extension of time to respond to defendant's motion to dismiss the complaint pursuant to Fed. R. Civ. P. 12(b)(6). (Doc. 19). Defendant has filed a response to the request in which he states he does not oppose an extension of time for plaintiff to respond to the motion to dismiss. (Doc. 20). For good cause shown, plaintiff is hereby GRANTED an extension of time of twenty (20) days from the filing date of this Order to file a response to defendant's motion to dismiss the complaint.

Plaintiff erroneously refers to defendant's motion to dismiss the complaint (Doc. 16) as a motion for summary judgment and has requested an extension of time under Fed. R. Civ. P. 56.

IT IS SO ORDERED.
