HILL COUNTRY PRESERVATION, LLC, Appellant, v. PHILIP KING AND SYNCHROPILE, INC., Appellees.

Appeal from the 38th District Court of Real County, Texas (TC# 2023-3796-DC)

Before Rodriguez, C.J., Palafox and Soto, JJ.

ORDER

PER CURIAM

Before the Court is Appellees' unopposed motion to supplement the reporters record. Attached to Appellees' motion is a transcript from a hearing, which Appellees state is a true and correct copy. Appellees' further state that they have been unable to obtain an official copy of the attached transcript.

Appellees represent that Appellant is unopposed to supplementing the record with the transcript attached to Appellees' motion. We therefore construe Appellees' motion as a motion to supplement by stipulation and agreement of the parties pursuant to Texas Rule of Appellate Procedure 34.6(e)(1). TEX. R. APP. P. 34.6(e)(1) (allowing parties to correct the reporter's record by agreement without the court reporter's recertification); see also TEX. R. APP. P. 34.6(c)(2) (allowing parties to designate additions to be included in the reporter's record). The motion is GRANTED. The Court has this day filed the attachment to Appellees' motion as a first supplemental reporter's record in this cause.

IT IS SO ORDERED.
