Appeal from the Erie Trial Term.

Present — Williams, P.J., Goldman, Halpern, McClusky and Henry, JJ.


Judgment as to defendant David Beckwith unanimously affirmed, with costs; judgment as to the remaining defendants reversed on the law and facts, without costs of this appeal to either party, and a new trial granted. Memorandum: The verdict against the defendants Obletz and Lee's Wholesale Drugs, Inc., is against the weight of evidence.
