ORDER


This 27th day of October 2009, after careful consideration of the opening brief filed by the appellant, Lester Hickman, and the motion to affirm filed by the appellee, State of Delaware, we conclude that the judgment of the Superior Court should be affirmed on the basis of the Court's well-reasoned decision dated April 14, 2009. The Superior Court did not err when concluding that Hickman's fourth motion for postconviction relief was appropriately barred as procedurally defaulted without exception. Moreover, the Court agrees with the State that Hickman's fourth postconviction motion also is appropriately barred as untimely and repetitive without exception.

NOW, THEREFORE, IT IS ORDERED that, pursuant to Supreme Court Rule 25(a), the State's motion to affirm is GRANTED. The judgment of the Superior Court is AFFIRMED.
