Judgment of the County Court of Nassau county reversed and new trial ordered, with costs to abide the event, upon the ground that the question of defendant's negligence should have been submitted to the jury. Jenks, P.J., Rich, Putnam, Blackmar and Jaycox, JJ., concur.
