Hernandez v. State

District Court of Appeal of Florida, Second District
Nov 3, 1993
626 So. 2d 1011 (Fla. Dist. Ct. App. 1993)

Opinion

No. 92-02669.

November 3, 1993.

Appeal from the Circuit Court, Polk County, E. Randolph Bentley, J.

James Marion Moorman, Public Defender, and Tonja R. Vickers, Asst. Public Defender, Bartow, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Susan D. Dunlevy, Asst. Atty. Gen., Tampa, for appellee.

We affirm Jose Pedro Hernandez's convictions and sentences for two counts of attempted sexual battery on a child under twelve. We strike special probation condition six in its entirety and the alcohol restriction in special condition eleven because they are unrelated to his convictions. See Biller v. State, 618 So.2d 734 (Fla. 1993).

FRANK, C.J., and DANAHY and BLUE, JJ., concur.
