JAMES EUGENE HERMANSON, Appellant, v. THE THIRD JUDICIAL DISTRICT COURT OF THE STATE OF NEVADA, IN AND FOR THE COUNTY OF LYON; AND THE HONORABLE LEON ABERASTURI, DISTRICT JUDGE, Respondents.

ORDER DISMISSING APPEAL

James Eugene Hermanson appeals from an order of the district court denying a petition for a writ of mandamus. Third Judicial District Court, Lyon County; Leon Aberasturi, Judge.

This appeal has been submitted for decision without oral argument. NRAP 34(f)(3).

Hermanson petitioned the district court to issue a writ of mandamus ordering itself to produce evidence that it denied Hermanson's May 2017 motion to withdraw his guilty plea. The district court denied Hermanson's petition but also attached the order disposing of the motion to withdraw his guilty plea. Because the district court's order provided Hermanson the relief he sought in his petition, Hermanson was not an aggrieved party and has no standing to appeal. See NRAP 3A(a). Accordingly, we

ORDER this appeal DISMISSED.

In light of this order, we deny Hermanson's motion filed on January 15, 2019. --------
