No. 05-02-01097-CR.

Opinion Issued January 29, 2003. DO NOT PUBLISH, Tex.R.App.P. 47.

Appeal from the 265th Judicial District Court, Dallas County, Texas, Trial Court Cause No. F01-27703-R. DISMISSED.

Before Justices WHITTINGTON, RICHTER, and FRANCIS.

MEMORANDUM OPINION

Amanda Kay Hendricks appealed from the trial court's order placing her on deferred adjudication community supervision. The clerk's record has not been filed. By order of December 30, 2002, we adopted findings that appellant is not indigent and she has not made arrangements to pay for the clerk's record. We warned appellant that if we received written verification by January 10, 2003 that she had not made arrangements to pay for the clerk's record, we would dismiss the appeal pursuant to rule 37.3(b) without further notice. On January 16, 2003, we received notification from the District Clerk that appellant has not paid for the record. Accordingly, we dismiss the appeal for want of prosecution. See Tex. R. App. P. 37.3(b).

We also warned appellant that if we received verification she had not made arrangements to pay for the reporter's record, we would submit the appeal without the reporter's record. On January 13, 2003, we received verification that appellant has paid a deposit, but not the balance due, for the reporter's record. However, due to our disposition of the appeal, we need not address the failure to pay in full for the reporter's record.
