This case is calendared for a remote trial at the session of the Court scheduled to commence on April 18, 2022, for cases in which Charleston, West Virginia, is the place of trial. On March 25, 2022, respondent filed a motion to dismiss for failure to properly prosecute, indicating therein that petitioner's views as to the granting of respondent's motion are unknown.

Upon due consideration of the foregoing, it is

ORDERED that, on or before April 15, 2022, petitioner shall file a response to respondent's motion to dismiss for failure to properly prosecute filed March 25, 2022. It is further

ORDERED that respondent's motion to dismiss for failure to properly prosecute filed March 25, 2022, is set for remote hearing on Monday, April 18, 2022, at 10:00 a.m. (ET). Petitioner is advised that failure to comply with this order or failure to appear at the remote hearing on April 18, 2022, may result in the Court granting respondent's motion and entering an order and decision against petitioner. It is further

ORDERED that the Clerk of the Court is directed to attach to this order a copy of the notice setting case for trial that was previously issued in this case on January 10, 2022.

This order constitutes official notice to the parties.
