PRESENT: , SMITH, CENTRA, PERADOTTO, AND CARNI, JJ.

Appellant having moved for an extension of time to perfect the appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Jefferson on November 13, 2014, and for permission to perfect the appeal without a stipulated or settled record,

Now, upon reading and filing the affidavit of Mark L. Osmundson sworn to March 6, 2015, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is dismissed as premature insofar as it seeks an extension of time to perfect the appeal (see 22 NYCRR 1000.13 [f]), and

It is further ORDERED that the motion is otherwise denied (see 22 NYCRR 1000.4 [a] [1] [ii]).
