Counsel for appellee has filed a motion to dismiss the appeal upon the ground that the appellant has failed to file assignments of error in accordance with the provisions of Rule 3.5, Florida Appellate Rules, and the Court having heard argument of counsel thereon, it is, upon consideration thereof,

Ordered and adjudged that the motion to dismiss be and the same is hereby granted and the appeal in this cause is hereby dismissed.
