District Court of Appeal of Florida, Second District
Apr 19, 1979
369 So. 2d 643 (Fla. Dist. Ct. App. 1979)

Opinion

No. 78-1251.

March 28, 1979. Rehearing Denied April 19, 1979.

Appeal from Circuit Court, Hillsborough County; Harry Lee Coe, III, Judge.

Jack O. Johnson, Public Defender, Bartow, and Karal B. Rushing, Asst. Public Defender, Tampa, for appellant.

Jim Smith, Atty. Gen., Tallahassee, and Michael A. Palecki, Asst. Atty. Gen., Tampa, for appellee.

We remand so that the lower court may correct the written order revoking appellant's probation to conform to the court's oral pronouncement, by striking the finding of violation of condition 4. We otherwise affirm the order of revocation, judgment, and sentence.

GRIMES, C.J., and SCHEB and DANAHY, JJ., concur.
