ORDER

The reporter's record was originally due to be filed in this appeal on November 8, 2017. One of the court reporters responsible for preparing the record filed her portion of the reporter's record on August 18, 2017. On November 28, 2017, the other court reporter responsible for preparing a portion of the reporter's record, Ms. Kay Gittinger, was notified that the reporter's record was late. On December 7, 2017, Ms. Gittinger filed a notification of late record requesting a thirty day extension to file her portion of the record, stating her other activities precluded her from working on the record. By order dated December 11, 2017, Ms. Gittinger's request was granted, extending the deadline to file the record to January 8, 2018, approximately sixty days from the date the record was originally due to be filed.

Despite the extended deadline, no reporter's record has been filed. It is therefore ORDERED that Ms. Gittinger file her portion of the reporter's record in this court no later than January 22, 2018. If the record is not received by such date, an order may be issued directing Ms. Gittinger to appear and show cause why she should not be held in contempt for failing to file the record. The clerk of this court shall cause a copy of this order to be served on Ms. Gittinger by certified mail, return receipt requested, or give other personal notice of this order with proof of delivery. Because "[t]he trial and appellate courts are jointly responsible for ensuring that the appellate record is timely filed," TEX. R. APP. P. 35.3(c), the clerk of the court is directed to serve a copy of this order on the Honorable Lorina I. Rummel, Judge of the 144th Judicial District Court.
