ORDER

Maurice B. Foley Chief Judge

On September 1, 2021, respondent filed a Motion To Dismiss for Lack of Jurisdiction. Therein, respondent requests that this case be dismissed on the ground that the petition was not filed within the time prescribed by the Internal Revenue Code. See I.R.C. secs. 6330(d), 7502.

Upon due consideration, it is

ORDERED that, on or before October 15, 2021, petitioner shall file an Objection, if any, to respondent's above-referenced motion. Therein, petitioner shall state the reasons for any such objection. Petitioner is advised that failure to comply with this Order may result in the granting of the motion to dismiss.
