Civil Action No. 3:02-CV-0827-N
June 6, 2003
ORDER
Before the Court are Defendant Dallas Independent School District's ("DISD") motion to dismiss [19] and amended motion to dismiss [20]. Plaintiff's complaint reads in its entirety as follows:
As a result of [Defendant's] conduct, Plaintiff suffered the following injuries and damages. Plaintiff was denied promotion or advancement in employment, which resulted in loss of pay and benefits. Plaintiff suffered mental anguish and emotional distress in the form of repeated embarrassment, humiliation, degradation, lack of self worth, poor self-esteem, and lack of self respect; further plaintiff suffered physical injury and physical illness including but not limited to psychological and physical injury.
Plaintiff's complaint wholly fails to set forth any basis for this Court's subject matter jurisdiction over the complaint. Although the Civil Cover Sheet indicates that the "Nature of Suit" is Civil Rights — Employment and describes the cause of action as "Title VII of the Civil Rights Act, the Americans with Disabilities Act," the Civil Cover Sheet does not replace or supplement a pleading. Moreover, the complaint fails to allege facts that would support relief under any Title VII or the Americans with Disabilities Act. Accordingly, DISD's motion to dismiss for lack of subject matter jurisdiction and failure to state a claim upon which relief can be granted is GRANTED.
