SHIRLEY HARTSFIELD, Appellant v. BANK OF AMERICA, Appellee

On Appeal from the 162nd Judicial District Court Dallas County, Texas
Trial Court Cause No. DC-16-08202

ORDER

Before the Court is appellant's January 25, 2018 motion for an extension of time to file a notice of appeal. We GRANT the motion. The notice of appeal filed on November 27, 2017 is deemed timely for jurisdictional purposes.

We DENY appellee's February 7, 2018 motion to dismiss the appeal.

The reporter's record is overdue. Based on the clerk's record, it appears appellant is allowed to proceed without costs. Accordingly, we ORDER Sheretta Martin, Official Court Reporter for the 162nd Judicial District Court, to file, by March 1, 2018, either (1) the reporter's record or (2) written verification that appellant has not requested preparation of the reporter's record. We caution appellant that if the Court receives written verification of no request, the Court will order the appeal be submitted without the reporter's record. See TEX. R. APP. P. 37.3(c).
