The "Extraordinary Writ Petition" is hereby granted to the extent petitioner seeks reinstatement of his proceedings in the First District Court of Appeal. The First District Court of Appeal is directed to reinstate Hartley v. McDonough, No. 1D07-3607 as a plenary appeal. Because the Court trusts that the First District Court of Appeal will fully comply with the dictates of this order, it withholds issuance of the writ.

The "Motion for Expeditious Review, Appointment of Counsel and or Oral Argument or Evidentiary Proceeding" is denied.
