ORDER


Came on for consideration the above-captioned action wherein Ross Hart, III, is petitioner and Douglas Dretke, Director, Texas Department of Criminal Justice, Correctional Institutions Division, is respondent. This is a petition for writ of habeas corpus filed pursuant to 28 U.S.C. § 2254. On December 22, 2003, the United States Magistrate Judge issued his proposed findings, conclusions, and recommendation, and ordered that the parties file objections, if any, thereto by January 12, 2004. The court has reviewed respondent's objections, filed on January 7, 2004, and is satisfied that the magistrate judge reached the correct conclusion — that petitioner has sufficiently exhausted his claim that his guilty plea was involuntary. Because petitioner has not filed any objections, and the court rejects respondent's objections, the court accepts the proposed findings, conclusions, and recommendation of the United States Magistrate Judge.

The court ORDERS that the petition be, and is hereby, denied.
