LANDLORD AND TENANT, § 321.1when action for possession for landlord's occupancy was within requirements of O. P. A. Act. Where action of forcible detainer to recover first apartment was brought by owner, and defendant contended that plaintiff was not acting in good faith within meaning of section 6(a) of O. P. A. Act, and it appeared that plaintiff lived with his father in second floor apartment, which had no bedroom, and after his father remarried, plaintiff desired to move, with his father and step-mother, into apartment occupied by defendant which had two bedrooms, held that judgment in plaintiff's favor should be affirmed.

Appeal from the Municipal Court of Chicago; the Hon. FRANK E. DONOGHUE, Judge, presiding.

Judgment affirmed. Heard in the first division, first district, this court at the October term, 1945.
