September 15, 2005.

APPEAL FROM THE FIRST CIRCUIT COURT (S.P.P. NO. 04-0023) (CR. NO. 94-2434)).

Gene Harrison, petitioner-appellant pro se, on the request.

ORDER DENYING REQUEST FOR WITHDRAWAL OR DISMISSAL

Upon consideration of Petitioner-Appellant Gene Harrison's letter filed on August 9, 2005 seeking dismissal or withdrawal of his appeal to enable him to properly petition for post conviction relief in the future, the papers in support, and the records and files herein, it appears Appellant does not understand the consequences of dismissing his appeal. Therefore,

IT IS HEREBY ORDERED that the request for withdrawal or dismissal of appeal is denied without prejudice to Appellant submitting a subsequent request that indicates an understanding of the consequences of dismissing his appeal.
