I dissent from the denial of certiorari by the majority on authority of Haile v. Bullock, 83 Fla. 538, 91 So. 683 (1922); Stipp v. State, 371 So.2d 712 (Fla. 4th DCA 1979), cert. denied, 383 So.2d 1203 (Fla. 1980); Johnson v. State, 249 So.2d 470 (Fla. 3d DCA 1971), cert. discharged, 280 So.2d 673 (Fla. 1973); and State v. Smith, 118 So.2d 792 (Fla. 1st DCA 1960).
