MEMORANDUM OPINION


Appellant has not paid the $125 filing fee in this appeal. By notice dated January 29, 2003, appellant was instructed to remit the $125 filing fee within ten days or face the consequence of the dismissal of his appeal for want of prosecution. By letter dated February 3, 2003, appellant was also instructed to provide proof of service of the notice of appeal to the opposing party. See Tex.R.App.P. 9.5. Appellant was informed that failure to provide proof of service within ten days would result in the dismissal of his appeal. The February letter also reminded appellant that his $125 filing fee was due, and that failure to remit the fee would result in dismissal. Appellant has failed to respond.

On the Court's own motion, this appeal is DISMISSED for want of prosecution. See Tex.R.App.P. 42.3(b), (c).
