PRESENT:

Appellant having moved for permission to proceed as a poor person on the appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Monroe on September 20, 2017,

Now, upon reading and filing the affidavit of Amy Harkins sworn to October 27, 2017, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied insofar as it seeks poor person relief on the ground that the facts as set forth by appellant fail to demonstrate merit to the appeal.
