And plaintiff-appellant having moved for a preliminary injunction and/or to otherwise temporarily enjoin, stay and toll the February 21, 2023 order and to suspend further disclosure by plaintiff until defendants comply with their obligations for pretrial disclosure (Motion No. 2023-01214), And defendants-respondents Eli Braha, Ralph Braha, David Braha, and Braha Industries, Inc. having cross-moved for an award of reasonable costs and attorney's fees associated with having to oppose plaintiff's motion (Motion No. 2023-01475), Now, upon reading and filing the papers with respect to the motion and cross motion, and due deliberation having been had thereon, It is ordered that the motion and cross motion are denied.
