Respondents having moved and cross-moved to dismiss the appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Onondaga on February 8, 2013, on the ground that appellant has failed to perfect timely the appeal,

Now, upon reading and filing the affidavit of Kristin L. Norfleet, Esq., sworn to June 6, 2013, the affidavit of Brendan J. Reagan, Esq., sworn to June 13, 2013, and the notices of motion and cross motion with proof of service thereof,

It is hereby ORDERED that the motions are granted, and the appeal is dismissed without costs.
