          STIPULATION OF REQUEST FOR DISMISSAL AS TO ENTIRE ACTION WITH PREJUDICE and ORDER OF DISMISSAL

          SUSAN ILLSTON, Chief District Judge.

         THE PARTIES TO THIS ACTION hereby stipulate through their designated counsel that the above-captioned action be dismissed with prejudice pursuant to Federal Rules of Civil Procedure, Rule 41(a)(1), with each party to bear its own costs and attorneys fees.

          ORDER

         Based upon the foregoing stipulation, and good cause appearing,

         IT IS HEREBY ORDERED that this action be dismissed with prejudice. The parties shall bear their own fees and costs.
