District Court of Appeal of Florida, Third District
Sep 28, 1993
623 So. 2d 606 (Fla. Dist. Ct. App. 1993)

Opinion

No. 93-260.

August 31, 1993. Rehearing Denied September 28, 1993.

An Appeal from the Circuit Court for Dade County, Paul Siegel, Judge.

H.T. Smith and Charlene Honig, Miami, for appellant.

Robert A. Butterworth, Atty. Gen., and Fleur J. Lobree, Asst. Atty. Gen., for appellee.

Before SCHWARTZ, C.J., and BARKDULL and HUBBART, JJ.

We find no merit in either of the arguments presented for reversal of the conviction which is therefore affirmed. However, in view of the admitted uncertainty concerning the proper computation of guidelines points, the sentence is vacated and the cause remanded for resentencing.
