Dwight HAMPTON, Appellant v. THE STATE OF TEXAS, Appellee

From the 186th Judicial District Court, Bexar County, Texas

Trial Court No. 2012CR6905

Honorable Maria Teresa Herr, Judge Presiding

ORDER

The Trial Court's Certification of Defendant's Right of Appeal contained in the clerk's record certifies that the underlying criminal case "is a plea-bargain case, and the defendant has NO right of appeal." However, the plea-bargain agreement contained within the clerk's record is blank. As a result, this Court cannot determine from the clerk's record if the trial court's judgment was in accordance with the plea-bargain agreement. We therefore reinstate appellate deadlines and ORDER the court reporter to file the reporter's record on or before July 12, 2013.

______________

Karen Angelini, Justice

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 12th day of June, 2013.

______________

Keith E. Hottle

Clerk of Court
