The above entitled case is transferred to the Court of Appeal, Fifth Appellate District, for reconsideration in light of the Attorney General's concession that the trial court improvidently dismissed plaintiff Paul C. Hamilton's complaint because the court could have allowed him to appear for trial by telephone. (Cal. Rules of Court, rules 3.670(f)(3), 8.528(d).)
