Opinion

No. 04-05-00335-CV

Delivered and Filed: July 13, 2005.

Appeal from the 166th Judicial District Court, Bexar County, Texas, Trial Court No. 2005-CI-03935, Honorable John J. Specia, Jr., Judge Presiding.

Dismissed.

Sitting: Alma L. LÓPEZ, Chief Justice, Catherine STONE, Justice, Rebecca SIMMONS, Justice.

MEMORANDUM OPINION

From our initial review of the record it appeared that Appellant's notice of appeal was not timely filed. Therefore, on June 8, 2005, we ordered appellant to show cause in writing by June 23, 2005, why this appeal should not be dismissed for lack of jurisdiction. The original notice was sent to the North Texas Intermediate Sanction Facility in Fort Worth, Texas. The clerk of this court received notification that Appellant no longer resided at such location. Following receipt of the notice, Appellant personally provided a new address to the court. The clerk then sent notice to Appellant at the address provided by Appellant. However, notice to the new address was returned by the United States Postal Service as "attempted not known." Appellant has not responded to this court's show cause order.

Therefore, this appeal is dismissed for lack of jurisdiction. See Tex.R.App.P. 42.3(a). Costs of appeal are taxed against appellant.
