ORDER

Patrick J. Urda, Judge.

This case is currently calendared on the Court's Atlanta, Georgia trial session, scheduled to begin January 9, 2023.

On December 9, 2022, the Commissioner filed a motion to dismiss for failure to properly prosecute, and the Court subsequently directed petitioner Samara Ravelle Hall to file a response to the motion. Ms. Hall has not filed a response.

On January 5, 2023, the Court held a conference call with the parties to discuss the status of this case. In light of the discussion, it is

ORDERED that the Commissioner's motion to dismiss for failure to properly prosecute is denied without prejudice. It is further

ORDERED that, on the Court's own motion, this case is continued from the above-referenced trial session and restored to the general docket.
