This case is calendared for a remote trial at a date and time certain of 10:00 a.m. (EST) on Tuesday, November 15 through Wednesday, November 16, 2022.
On August 30, 2022, petitioner filed a motion for document subpoena hearing. By order issued September 14, 2022, the Court granted petitioner's motion and scheduled this case for hearing on the status of the case at a Washington, D.C., special hearing session of the Court to be conducted remotely at a date and time certain of 1:00 p.m. (EST) on Wednesday, October 5, 2022.
On September 26, 2022, petitioner filed a status report. On October 4, 2022, petitioner filed a second supplemental status report. In that supplemental status report, petitioner represents that due to Hurricane Ian, petitioner is unable to locate a physical address of the third party, Chargeback 360, LLC, and that petitioner "has not been able to effect service of the subpoena duces tecum on CB360 [Chargeback 360, LLC]". Petitioner further stated that "it would be unfair to hold the hearing on October 5, 2022[,] since CB360 [Chargeback 360, LLC] has not had prior notice of the hearing and the opportunity to respond to the subpoena duces tecum." Consequently, the Court will strike this case for hearing from the Court's October 5, 2022, special hearing session.
Upon due consideration and for cause, it is
ORDERED that this case is hereby stricken from the special hearing session of the Court scheduled commence on Wednesday, October 5, 2022, at 1:00 p.m. (EST).
