Hairston v. Eighth Judicial Dist. Court

COURT OF APPEALS OF THE STATE OF NEVADA

No. 76004 (Nev. App. Sep. 26, 2018)

Opinion

LEONARD MORGAN HAIRSTON, Petitioner, v. THE EIGHTH JUDICIAL DISTRICT COURT OF THE STATE OF NEVADA, IN AND FOR THE COUNTY OF CLARK, Respondent, and THE STATE OF NEVADA, Real Party in Interest.

ORDER DENYING PETITION

This is an original petition for a writ of habeas corpus. Leonard Morgan Hairston asserts the district court acted without jurisdiction and without authority of law by continuing with proceedings against him after the Nevada Supreme Court dismissed his appeal for lack of jurisdiction. Having considered all documents filed in this matter, we conclude no relief is warranted. The Nevada Supreme Court's dismissal of Hairston's appeal for lack of jurisdiction did not constitute a final decision in his criminal case or deprive the district court of jurisdiction to proceed with his criminal case. Therefore, he has failed to demonstrate the district court lacked jurisdiction or he is being illegally restrained. See NRS 34.360. Accordingly, we

ORDER the petition DENIED.
