ORDER

Michael F. Gadola, Chief Judge Pro Tem, acting under MCR 7.211(E)(2), orders:

The motion for sanctions for vexatious proceedings is DENIED without prejudice to such a motion being refiled after this case is submitted on case call. This order is also without prejudice to appellee's ability to file a motion to affirm under MCR 7.211(C)(3) if it considers it appropriate to do so and, in the event such a motion to affirm is granted, to then refile a motion for sanctions for vexatious proceedings in accordance with MCR 7.211(C)(8).
