Arthur Gutierrez v. Anning-Johnson Company, et al.

CIVIL MINUTES - GENERAL

JOHN A. KRONSTADT, UNITED STATES DISTRICT JUDGE

Proceedings: PLAINTIFF'S MOTION TO REMAND ACTION TO STATE COURT (DKT. 16)

DEFENDANT ANNING-JOHNSON COMPANY'S MOTION TO DISMISS COMPLAINT OR, IN THE ALTERNATIVE, COMPEL ARBITRATION AND STAY PROCEEDINGS (DKT. 18)

The motion hearing is held via zoom webinar. Counsel, the Court, and court staff all appear in that manner. Recording or re-broadcasting of the proceedings is strictly prohibited. The Court states its tentative views that it is inclined to deny Plaintiff's Motion to Remand Action to State Court (Dkt. 16) and grant Defendant Anning-Johnson Company's Motion to Dismiss Complaint or, in the Alternative, Compel Arbitration and Stay Proceedings (Dkt. 18) (together, the “Motions”). Counsel address the Court. The Court takes the Motions UNDER SUBMISSION and a ruling will be issued.

The Court confers with counsel regarding settlement discussions. Counsel state that further settlement discussions will be most productive after the Motions are resolved.

IT IS SO ORDERED.
