Kirk A. Grogan Petitioner v. Commissioner of Internal Revenue Respondent

ORDER

Emin Toro Judge

This case is currently set for trial during the Court's April 4, 2022, San Francisco, California, trial session.

On December 21, 2021, petitioner's counsel, Douglas A. Greenberg, filed a Motion to Withdraw as Counsel (Doc. 11). The motion fails to comply with Rule 24(c)(4)(A) because it does not "include a statement that counsel * * * provided prior notice of the motion * * * to each of the other parties to the case or their counsel and whether there is any objection to the motion." Moreover, the motion fails to comply with Rule 24(c) (4)(B) because it does not "include the party's then-current mailing address, email address (if any), and telephone number" or indicate that such information is unavailable to counsel. In view of the foregoing, we will deny the motion without prejudice to the motion being renewed with the information required by Rule 24(c)(4)(A) and (B).

Upon due consideration, it is hereby

ORDERED that petitioner's counsel Douglas A. Greenberg's Motion to Withdraw as Counsel is denied without prejudice to counsel's right to renew.
