STIPULATION AND ORDER


IT IS HEREBY STIPULATED AND AGREED by the undersigned counsel for the parties as follows:

1. This action is hereby stayed until December 31, 2005;

2. The defendant's time to answer or otherwise respond to the Amended Complaint is adjourned sine die;

3. Within five days of the expiration of the stay, the parties shall notify the Court whether they intend to submit a Stipulation of Discontinuance to the Court and, if not, shall request a preliminary conference at the Court's earliest convenience; and

4. For the purposes of this Stipulation a facsimile signature shall be deemed an original.

SO ORDERED.
