James Joshua GRIFFIN, Appellant v. The STATE of Texas, Appellee

From the 290th Judicial District Court, Bexar County, Texas Trial Court No. 2019CR11589 Honorable Jennifer Pena, Judge Presiding

ORDER

Beth Watkins, Justice

Appellant's brief was originally due March 24, 2023. Appellant's first motion for extension of time was granted, extending the deadline for filing the brief to April 24, 2023. On April 24, 2023, appellant filed a motion requesting an additional extension of time to file the brief until May 24, 2023, for a total extension of 61 days, and we granted appellant's motion.

On May 25, 2023, appellant filed a third motion for extension of time requesting an additional 30 days to file the brief, for a total extension of 91 days. After consideration, we GRANT IN PART the motion and ORDER appellant to file his brief by June 22, 2023. No further requests for extension of time will be considered absent extraordinary circumstances.

If the brief is not filed by the date ordered, we will order the appeal abated and remand the cause to the trial court for a hearing to determine whether appellant or appointed counsel has abandoned the appeal. See TEX. R. APP. P. 38.8(B)(2).
