ORDER OF DISMISSAL AND DECISION

Patrick J. Urda, Judge.

On August 8, 2023, the Commissioner filed a motion to dismiss for lack of prosecution asking the Court to dismiss this case and enter a decision in the amount set forth in the notice of deficiency issued to petitioner Jasmine Michele Griffin for taxable year 2020. Subsequently, the Court issued an Order directing Ms. Griffin to file a response to the Commissioner's motion on or before September 1, 2023. Ms. Griffin has not filed a response to our Order.

This case was called from the calendar for the trial session of the Court at Cincinnati, Ohio on September 11, 2023. There was no appearance by or on behalf of Ms. Griffin. Counsel for the Commissioner appeared and was heard. The Court set this case for recall the next day.

This case was recalled from the calendar on September 12, 2023. Ms. Griffin again did not appear, but counsel for the Commissioner appeared and was heard. Upon due consideration and for cause more fully appearing in the transcripts of the proceedings, it is

ORDERED that the Commissioner's motion to dismiss for lack of prosecution filed August 8, 2023, is granted, and this case is dismissed for lack of prosecution. It is further

ORDERED AND DECIDED that there is a deficiency in income tax due from the petitioner for taxable year 2020 in the amount of $3,780.
