In an action by the purchaser of shares of stock to recover damages for breach of contract and for fraud inducing the making of the contract to purchase said stock, and for other relief, the plaintiff appeals from an order of the Supreme Court, Nassau County, dated June 17, 1960, denying its motion to vacate notices of its examination before trial. Order affirmed, with $10 costs and disbursements. No opinion. The examination shall proceed on 10 days' written notice or on any other date mutually fixed by the parties. Beldock, Acting P.J., Ughetta, Christ and Pette, JJ., concur.
