Case No. 1:10-CV-347 (S.D. Ohio Sep. 28, 2010)

Opinion

Case No. 1:10-CV-347.

September 28, 2010

ORDER

The instant case was removed from the Hamilton County Court of Common Pleas to this Court on May 27, 2010. Thereafter, Plaintiffs filed a Motion to Remand, which is currently under review. On September 27, 2010, this Court held a telephonic conference to address the recent removal of various items, including wood moldings, stained glass windows, and doors from a single family home at 2918 Werk Road — the property forming the subject of the instant lawsuit.

Due to concern that Plaintiffs or individuals or organizations associated with Plaintiffs will strip the property of any items of value before the Court has the opportunity to resolve the issues before it, the Court hereby ORDERS that nothing else be removed from the house without prior approval of this Court. As of October 1, 2010, all structural items that have been removed from the house, including windows and doors, must be returned to the house and restored to the condition in which they were found prior to removal. Further, all non-structural items that were removed from the house must either be restored to their original location in the house or be maintained in good condition in the barn located at 2918 Werk Road, where they are currently being stored.

IT IS SO ORDERED.
