Pro Se Petition for Review [Circuit Court of Desha County, CR 2007-121, Hon. Samuel Pope, Judge], Petition Dismissed.


Petitioner Robert Green, Jr., was found guilty by a jury of delivery of a controlled substance and sentenced to 600 months' imprisonment. The Arkansas Court of Appeals affirmed. Green v. State, 2009 Ark. App. 589. Now before us is petitioner Green's pro se petition for review of the decision of the court of appeals.

We do not reach the merits of the petition because petitioner filed the petition proceeding pro se, even though he was represented by counsel on appeal. We do not allow a petitioner to substitute his judgment concerning whether and how to request a petition for review for that of his attorney. George v. State, 2009 Ark. 444 (per curiam); Brewer v. State, 371 Ark. 532, 268 S.W.3d 332 (2007) (per curiam). Accordingly, the petition is dismissed.

Petition dismissed.
