Appeal and Error — Reversal — Failure of Defendant in Error to File Brief.

Where the defendant in error fails to file brief, this court may exercise its discretion under rule 7 of the rules of this court to reverse the cause without an examination of the record.

Error from District Court, Ottawa County; J.J. Smith, Judge.

Action between Alva R. Green and Jack-Pinnell. From the judgment, the former appeals. Reversed and remanded.

Under authority of Ellis v. Outler, 25 Okla. 469, 106 P. 957, this cause is reversed and remanded for failure of defendant in error to file brief as required by rule 7 of this court.
