ORDER

Alina I. Marshall Judge.

This case is calendared for a remote trial at the session of the Court scheduled to commence on October 18, 2021, for cases in which Dallas, Texas, is the place of trial. On September 22, 2021, respondent filed a motion to dismiss for failure to properly prosecute, indicating therein that petitioners' views as to the granting of respondent's motion are unknown.

Upon due consideration of the foregoing, it is

ORDERED that, on or before October 8, 2021, petitioners shall file a response to respondent's motion to dismiss for failure to properly prosecute filed September 22, 2021. It is further

ORDERED that respondent's motion to dismiss for failure to properly prosecute filed September 22, 2021, is set for remote hearing on Monday, October 18, 2021, at 10:00 a.m. (ET). Petitioners are advised that failure to comply with this order or failure to appear at the remote hearing on October 18, 2021, may result in the Court granting respondent's motion and entering an order and decision against petitioners. It is further

ORDERED that the Clerk of the Court is directed to attach to this order a copy of the notice setting case for trial that was previously issued in this case on July 20, 2021.

This order constitutes official notice to the parties.
