Opinion

No. 05-95-00043-CV

Opinion issued August 26, 2004.

On Appeal from the 68th Judicial District Court, Dallas County, Texas, Trial Court Cause No. 94-05207-C.

Before Justices MOSELEY, BRIDGES, and LANG-MIERS.

MEMORANDUM OPINION

The Court REINSTATES this appeal. The Court abated this appeal on June 5, 1995 due to bankruptcy of one of the parties. Since the abatement there has been no activity in this appeal. The Court sent a letter to the parties or their counsel of record on July 22, 2004 instructing them to file, within fourteen days of the date of the letter, a motion to reinstate, motion to dismiss, or to advise the Court what action should be taken in the case. The letter advised the parties that failure to do so would result in dismissal of the appeal. Counsel for appellee responded that the bankruptcy has been terminated and that Ms. Gossett is deceased. The Court did not receive any response from Gossett's counsel. Consequently, the Court determines that the parties no longer desire to prosecute this appeal and the Court DISMISSES this appeal. Tex.R.App.P. 42.3(b) and (c).
